1. INTRODUCTION
Welcome to National Energy Solutions, LLC, doing business as P.E.A.C.H. (Public Energy Assistance Center for Homeowners) ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website located at nationalenergysolutions.org (the "Site") and any related services, sales, marketing, or facilitation provided by us (collectively, the "Services").
By accessing or using the Site or Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.
IMPORTANT DISCLAIMER: P.E.A.C.H. is a private entity acting as a Participating Contractor and facilitator for state and federal energy rebate programs. We are NOT a government agency, nor are we an employee or direct representative of the Georgia Environmental Finance Authority (GEFA) or the U.S. Department of Energy (DOE).
2. NATURE OF SERVICES
Our Services are limited to the following:
Eligibility Assessment: Assisting homeowners in determining potential eligibility for government-funded energy rebates (such as the HEAR and HER programs).
Facilitation: Facilitating the application, documentation, and compliance process for said rebates.
Connection: Connecting eligible homeowners with third-party licensed contractors ("Installation Partners") to perform energy upgrades.
3. REBATE ELIGIBILITY & CONTINGENCY
By using our Services, you acknowledge and agree to the following regarding all rebates and incentives:
No Guarantee: While we strive to accurately qualify every project based on the information provided, the final approval of any rebate is at the sole discretion of the funding agency (e.g., GEFA). We do not and cannot guarantee the approval or payment of any rebate.
Contingent Pricing: Any "Net Cost," "$0 Out-of-Pocket," or "Cost-Covered" estimates provided by the Company are strictly contingent upon the final approval and funding of the applicable rebate.
Homeowner Liability: If a rebate is denied due to the Homeowner's provision of false, inaccurate, or incomplete information (including but not limited to income data, property ownership status, or household size), the Homeowner shall be fully liable for the total cost of the project and equipment installed.
4. USER RESPONSIBILITIES
To use our Services, you agree to:
Accuracy: Provide true, accurate, current, and complete information regarding your identity, household income, and property ownership.
Documentation: Submit all required documentation (e.g., tax returns, pay stubs, benefits letters) in a timely manner.
Security: Maintain the confidentiality of any login credentials used to access our portals.
Access: Allow the Company and its Installation Partners reasonable access to your property for the purpose of scoping, installing, and inspecting the upgrades.
5. RELATIONSHIP WITH INSTALLATION PARTNERS
Independent Contractors: All physical installation work (including HVAC, electrical, and insulation services) is performed by independent third-party contractors ("Installation Partners"), not by National Energy Solutions, LLC.
No Liability for Workmanship: The Company is not responsible or liable for the acts, omissions, workmanship, delays, or negligence of any Installation Partner. Any warranties regarding equipment or labor are strictly between the Homeowner and the Installation Partner/Manufacturer.
6. INTELLECTUAL PROPERTY
The Site and its original content, features, and functionality are and will remain the exclusive property of National Energy Solutions, LLC and its licensors. The name "P.E.A.C.H.," "Public Energy Assistance Center for Homeowners," and all related logos are trademarks of the Company. You may not use them without our express written permission.
7. LINKS TO OTHER WEBSITES
Our Service may contain links to third-party web sites or services that are not owned or controlled by National Energy Solutions, LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You acknowledge and agree that National Energy Solutions, LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
8. LIMITATION OF LIABILITY
In no event shall National Energy Solutions, LLC, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
To the fullest extent permitted by Georgia law, our total liability to you for any claim arising out of these Terms shall not exceed the amount of fees actually paid by you to the Company, if any.
9. INDEMNIFICATION
You agree to defend, indemnify and hold harmless National Energy Solutions, LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
10. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved specifically in the state or federal courts located in DeKalb County, Georgia.
11. CHANGES TO TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
